PROGRAM OVERVIEW:
On May 2, 2018, former Governor Kasich signed House Bill 478, legislation regulating the deployment of small
cell wireless infrastructure in municipal rights-of-way, into law. According to the Ohio Municipal League, the
signing of this bill “mark[ed] the achievement of both municipal leaders across the state and the
telecommunications industry representatives who spent countless hours . . . to reach a compromise of both
parties.” In 2019, an Order from the Federal Communications Commission (FCC) went into effect that further
restricted the timeline, fees, aesthetics, and more. This webinar will overview the federal and state restrictions
on requirements that municipalities may seek to impose on small cell infrastructure expansion in rights-of-way
and opportunities to still be proactive in the construction of such facilities within your municipality.

Chris Miller advises private entities, public agencies and individuals on legal issues relating to energy and
utility matters, telecommunications (both wired and wireless), broadband services, information technology
and associated regulatory matters. Chris has represented a number of clients in the formation and operation
of sophisticated public private partnerships (“P3s”) involving energy and telecommunications infrastructure,
including the representation of one of the largest universities in the United States in a $1B+ long term
comprehensive energy management concession process. He has significant experience representing clients'
interests in proceedings before the Ohio Public Utilities Commission, Ohio Power Siting Board, the FCC and
other regulatory agencies.
